ESTATE PLANNING

Estate planning is a broad, far-reaching subject.

Although there are countless estate planning options, there are a few documents that almost everyone considered when creating their estate plan:

  • Last Wills and Testaments – Wills say what happens to your “stuff” (your assets) after you die. However, Wills still have to go through probate after your death.

  • Trusts – Like Wills, Trusts say what happens to your “stuff” after you die. But unlike a Will, a Trust can avoid the probate process entirely.

  • Durable Powers of Attorney – A Power of Attorney appoints someone (your “Attorney-in-Fact”) to act for you in certain situations, such as making medical or financial decisions. A Power of Attorney is “durable” if it does not expire if you become incompetent.

  • Advance Directive for Health Care – Often called a “living will,” an Advance Directive lets you state your preference regarding end-of-life decisions such as whether you want to stay connected to life support.

PROBATE AND ESTATE ADMINISTRATION
 

Probate is the process of a court transferring the assets from the name of the decedent to the name of that decedent's intended beneficiaries if there is a will, or to the names of the decedent's heirs at law if there is no will. This process also involves addressing any creditors claims, litigation against the estate, or challenges to estate planning documents.

At Wesner, Rainbolt & Regier, our office represents people in Oklahoma who have been named personal representative of a deceased person's estate. We also represent beneficiaries who are concerned with the way a personal representative is managing or distributing the estate and want to be sure their interests are protected. Our probate lawyers handle everything from:

  • Assist in taking an inventory of the assets, handling creditor claims, paying applicable taxes, and distributing the net assets of the estate to beneficiaries.

  • Monitoring the probate process for the benefit of the heirs and, if necessary, getting involved in will contests or other disputes to protect those heirs.

  • Our lawyers also defend personal representatives in will contests.

REAL ESTATE

At Wesner, Rainbolt & Regier, our office represent both commercial clients and individuals in all proceedings and transactions that deal with real property and the structures attached to it—including purchase and sale, construction, mortgages and foreclosures, leases, zoning, title examinations, quiet title actions, closings, and management.

More commonly, clients wish to transfer real estate or minerals to a family member or to a trust or business entity. We routinely prepare deeds, and, once executed, we take care of recording the signed document with the county clerk. Without proper execution and recording, your conveyance of real estate may not be effective or may have other adverse consequences to the parties involved.
